" you know your book is pretty apropos with what is going on right now. a lot of the disinformation that gets propagated by not only donald trump on his social media platform, by scholars as well. i did want to start with something familiar to you and i. that is being in court in front of judges. we heard judge walton do it.

interview on cnn and he spoke out against how the rule of law is under attack with donald trump, for example, posting notf only the name of a judge's daughter and posting threats against people like federal judges. can you give us context about what it means for a sitting federal judge, not retired judge, a sitting federal judge to speak out like this? >> it is quite extraordinary katie. judges typically speak only through their orders. they stay out of politics and i stay out of current affairs. they decide cases that come across their desk that are randomly assigned to them. judge walton is a republican appointee to the bench. he sees what is going on feels the need to speak out for himself and his colleagues as they come under fire by these threats unleashed by donald trump. we do not have to look back too far in history to know these threats can turn into reality, t in addition to what you mentioned on january 6th.

we've seen attacks against federal judges. a judge in new jersey had his son killed by a bullet intended for the judge. another judge in chicago, whose mother and father-sorry, mother and husband were killed by somebody looking for her. it is incredibly dangerous. and not only threatens the safety and lives of the people that occupy these jobs, but the very rule of law they are there to enforce. >> you and i have prosecuted people that are having celebrity status or political status that would merit them thinking or the public thinkingi to make it specialized treatment compared to regular joe citizens that have allegedly broken the law. talk a little bit about the fact that we now have donald trump released his third gag order. restricting his ability to attack people. not only members of court staff, but witnesses, u lawyers et cetera.

the fact that he now uses truth social to repost video of our sitting president, president joe biden, bound and gagged according to some, with a in bullet hole in his head in the back of a pickup truck. these things would never be tolerated by quote-" a criminal defendant. make it make sense in terms of people the same criticize the judicial system that it seems like there is more than a double standard that applies to donald trump. >> i think what we are seeing by the courts as a reluctance he in using the strength in the orders that the moment calls for . as you say, i have certainly participated in cases where there were gag orders in high- profile cases, there will be a lot of media attention. the purpose for the gag orders is to make sure the trials are conducted in courts and not in the public. not in the media.

where things may not be th permitted under the rules of evidence are out there potentially tainting a future jury pool. or when threats are involved. intimidating witnesses and the testimony of witnesses. judges had to balance first amendment rights of all litigants, but also the fear and administration of justice. that is where the gag order comes in. as long as they are narrowly rr tailored to achieve the government interest of affair and administration of justice and comply with the first amendment. the idea that donald trump's first amendment rights are being violated is absolute nonsense. is supreme court case law that says that. what former president trump will do is continue to look for cracks in the polls and drive a truck through them. for example, what we saw most recently was going after the nt judge's daughter, who is not technically one of the parties listed on the gag order. the gag order talks about the parties and their family members. it talks about court staff. talks about potential jurors

deliberately --. it generally berkeley left out the judge and prosecutor. so that there would be the opportunity for candidate for president to speak out about the prosecution and defend his innocent. going after the daughter is out of control and out of bounds. not only that, it was false information. i think what i would like to see -sister they have asked the judge to apply the gag order to the daughter. they need to amend the order to include the judge's family. the judge needs to show he means business by suggesting what sanctions are available if there is another violation. >> quickly, before have to let you go, one of the things that concerns me are the lawyers. i will say it is my opinion and i will put words in your mouth. lawyers that enable donald trump to put their bar number on file to say things like trump threatening the daughter

>> joining me now is msnbc political analyst. let's start with the radio city hall fundraiser a huge success and adding to the $100 million the biden campaign and yancy had in cash at the end of february. the number being twice as much as funds raised by the trump campaign and rnc. cash is king. how worried should donald trump now be? >> he should be worried katie. first and foremost, remember every dollar raised by the biden campaign goes to the biden campaign. whereas every dollar raised by trump, you don't know if it is going to legal expense is or not. he has topped $100 million as the trial has commenced over the course is -- what is left going into the summer. his legal bills will rise. the advantage for biden is to push the accelerator down and bring out the big guns, like he did with president obama and president clinton.

with the christians or evangelicals he is trying to court? >> no, he is playing the >> game. donald trump has gone full on televangelist, jimmy baker, jim baker, jimmy swaggart-style. whatever gimmick he can to bring in the cash. in spite of all of the talk about truth social, i feel he is cash-poor right now, as is the campaign. they will try to milk every single possible dollar they can from their trump base. it is not in any way try to expand the coalition or expand the base of supporters he has. he is literally doing aggressive televangelist-style. >> let's talk about the biden/harris campaign now making what i thought was interesting, a direct appeal to nikki haley voters/supporters with a new ad using trump's own words attacking the candidate. trump saying he does not need their votes, he is tried to give them a home.

do you think this ad an additional messaging will be enough to reach moderate voters that maybe would have supported nikki haley? is it enough to bring them over to the biden/harris campaign? >> maybe not today katie, but this is shrewd and smart politics by the i didn't campaign. what we are all seeing here is the pivot. this will be made a referendum on donald trump. the extremism represented by trump and the authoritarian, dictatorial style of government trump promises he will be day one if you regains power. what biden is doing is to say to all folks not comfortable with trump-listen, we may not agree on every policy, but we are bedrock loyal to the constitution. we will continue american democracy. there is room for you in our coalition and we will go and what you and we will be a president for you as well. will see more of this style.

not just engaging nikki haley voters, you will see attempt to go after chris cristi voters. even some ron desantis voters who have ill will toward donald trump. anyone comfortable with former president trump's who team biden is trying to expand the coalition of voters to go after. special going to stick with this. i would never expect nikki haley to endorse joe biden. >> when we see nikki haley's mindlessly go back into the trump camp when given the opportunity to self advance. what about somebody like chris cristi? somebody we know that definitively, vocally is anti- trump. is he willing to put up about the to endorse joe biden? >> it depends on outreach and what the president and his team are willing to do to court the votes. i pick one of the most extraordinary moments already happened katie was former vice president mike pence saying he will not endorse donald trump. if biden says, we could make a case here in moscow for true red- conservative republican is

writing, this case is unabashedly and specifically about punishing the defendants for their speech. quickly explain to our viewers why elon musk was targeting the center for countering digital hate. >> thank you for having me. it should be obvious to anyone. elon musk does not like when people criticize him. he really does not like it when a group is affected -- effective as our clients, run by enron, criticize him for the hate, vitriol, misinformation and sheer vile content on twitter which was unleashed when he took over the platform. their job is to write reports about disinformation. they wrote several about twitter and they did not like it. he threatened us by letter we said bring it on. we brought a lawsuit and won

the last. >> your nonprofit organization called the center for countering digital hate, i want to run through the numbers. i think it is important for the viewers to understand context. according to your group's research, engagements of hateful content jumped 49.5% after elon musk took over. your research office found using a sample of 300 hate speech posts, 86% were left up after being reported. and x failed to act on 99% of the hate posts if the user is subscribed to x premium. it sounds like x and elon musk are making money off hate account of his social media platform. >> he is and that was his plan. when he took over the platform, he put up a bat signal, did he not, to resist saying it is now an open space for the kind of abuse. another piece of research we

did on the week after he took over the platform, there was amicus motion in the use of hateful terms on his site. there was a tripling on a daily basis in the use of the most offensive term you can use against african americans. a tripling, as a result of his policies. a signal he sent to them. how we do in what respect is hold up a mirror to platforms. we study them using open techniques and detailed methodologies we asked people to consider, do you like what you see in the mirror? most people like what they see in the mirror. as it happens, the american justice system does not see that as an actionable claim. >> elon musk is becoming well known for his use of strategic lawsuits against public participation lawsuits, which are essentially intimidation critics. how dangerous are these type of

litigation tactics? >> they are extremely dangerous. the whole point of bringing a lawsuit- first, we do not think elon musk that he would win the lawsuit. it is about intimidating our clients enron and others to never criticize him again. that is why we have these lawns -- laws for frivolous lawsuits. the system works. judge breyer software it and said this is a slap lawsuit. and you will have to pay the costs. >> because of what is going on here, your company or nonprofit, it focuses on what you just talked about, evidence and facts. it tracks what is going on in terms of reality. do you feel-spacer you obviously have great counsel with robbie kaplan. doesn't have a chilling effect on other

nonprofit organizations similar to yours trying to make sure consumers are aware of the amount of hate speech and hate content on social media platforms? >> let me be clear. the organization i rent not only look at hate speech, we look at self harm content which is vital for america parents to understand. we look at a number of different types of information that can impact human health and human well-being and prosperity. it is really important this work is done. that is how free speech works. we have our opinions based on the facts we painstakingly researched. if we made a mistake, he could have sued us for defamation. it is telling that he did not. he cannot find a mistake in our work, instead he sued is the act of doing research. it was vital that we stood up in the face of a bully and said, sorry pal, we have the

fundamental right to research your platform to communicate about it. and it advertises, as in clinton's lawsuit, that he lost tens of millions dollars because of our research. that is their decision. it did have a chilling effect on the sector, but i can tell you that we have put out research on x since we've been sued. and we will put more out shortly. we will not be bullied. >> very quickly, i wanted to follow up about judge breyer saying to elon musk, you could have sued for defamation and you did not. why is that nuance important? >> we have a system in our country and culture that protects freedom of speech. people are supposed to be allowed to criticize each other online, publicly about what people are singing.

in march 2021 a shooting spree at two spots and a massage parlor in highlighted -- atlanta, highlighted to the nation how much hatred that asian-american community faces. eight people were killed and six of asian descent. a fulton county judge is allowing prosecutors to pursue the death penalty against the shooter who was already serving for my consecutive life sentences without the possibility of parole.

plus, additional 35 years for the victims he murdered in another country in georgia. aa ip hate is rampant across the country. the asian-american foundation reports, anti-asian rhetoric and violence the targeted a.a.p.i. communities has not stopped. a new study conducted in new york city has revealed one in two asian-americans experience insults, threats or physical attacks in just the last 12 months. joined me now is the ceo of the asian-american foundation, norman, i appreciate you coming back on the show to talk about this important survey. the first of its kind done by your organization. talk to the viewers and me about why you thought it was important to do it now and why you chose new york city. such a great to see you. >> there is a perception around

the country that anti-a.a.p.i. hate has come down from the peak after the small killings. what we want to do with the study with test that and see in one of the most challenges -- challenging city new york city, what ability was. the data was shocking. as you said, one in two asian- americans in new york city have faced some form of attack or assault. one in five has experienced a physical attack just in the past year alone. it shows the crisis has not moved on. our community still lives in fear and is taking prescience. every day of their lives, to avoid further violence and racism against themselves. >> norman, i want to drill down into the data. i think the numbers speak loudly about what is going on. nearly 2 million asian- americans in new york city. 83% of asian-american women and

72% of asian-american men say public safety is a huge concern. 75% of the respondents actually changed their daily routines and the behaviors to avoid expensing anti-aapi hate. norman, the numbers are astounding. do you suspect there is a replication of the percentages or numbers if you were to look at another city has a large aapi population? >> absolutely, these numbers are outstanding. the fact that people everyday are changing the lives and not taking the subway or public education is much. they are afraid to speak in their native leg which is because of a fear of being attacked. these are real instances. in cities like oakland and new york city, chinatown closing early because people are afraid to open up their stores and restaurants at nighttime. it is hurting their economic likelihood.

we plan to study other cities in the country. we expect we will see a center -- similar pattern of virtually. >> you mentioned one of the barriers i read about in your report. some of the victims did not want to bring attention to themselves, 42%. 29% said they did not know that they could report any of the incidents 27% saying they did not know how to do it. 26% saying they were uncomfortable reporting to law enforcement. 19% saying they felt ashamed or embarrassed to report. let's talk about solutions. norman, what type of solutions or resources are available that exist or need to be improved upon so that we can see tangible reductions in anti- aapi numbers? >> several solutions are necessary here katie. first of all, one of the greatest segues for the study is a greater awareness that the threat continues on a massive scale around the country needs to be addressed. part of the solution includes

more resources to help the aapi communities assessment report hate incidents. you can see many barriers out there. people are still not aware of the resources not enough resources are in the language one of the strengths of the study is rooted in multiple linkages. as a result, we reached part of our community that often times are not reached by surveys. two more things that should be done. increased investment in police and public relationships. increasing aapi education in classrooms or people to learn more that our community has been here for hundreds of years. we are not foreigners contribute to disney to the country and we should be treated fairly and justly. >> norman, you said something in the report with the executive summary that went on about the of the rain -- othering of our community.

you'll be the first vietnamese woman to fly in space. what does that mean to you after everything? >> oh, my gosh. i am so grateful. it has been such a week. hearing and listening to the messages come in. honestly, it comes from my heritage. what this means to me. my parents are refugees. my mom is a oat refugee from vietnam. we came on boats and now we are on spaceships. what is important to me is bringing my community with me. i know i may be the first, but i definitely want to make sure i am not the last. so that you originally entered at nasa in 2013. you have been training for years to become a astronaut. for those tuning in right now, it is not easy to train to go to space. doesn't like it has become a full circle moment for you? like i said in intro, you had to shelve this amazing dream that a lot of people never

achieve, to fight for the rights of others, including yourself, to make sure the world is a safer place before you went into the outer world. >> i want people to know, whether survivors or people who may not see themselves represented, that your dreams absolutely matter. just in general, people will only take your childhood dreams as seriously as you take them. a lot of people can feel like life gets in the way. i know what that feels like. to anyone who is having a hard time, and especially to the survivors we are seeing, i want you to know that you can absolutely heal. that person who was hurt. that person before you became part, that person still matters in your dreams can still come true. >> amanda, you are partnering with space for humanity. space for humanity is focused on democratizing space and making it accessible to everyone. what you think democratizing space is an important goal?

>> i look up at the stars and i see it has taken millions of years to reach our eyes. it feel so special, right? yes, at one point it makes me feel small. on the other hand, it makes me feel so special that we have the ability in the blink of an eye in the universe to love. to recommend who we are and fight for what we believe in. the mission is to democratize space and make sure people have access to what is called the overview effect a psychological experiences that a lot of astronauts have when they see earth for the first time. essentially, they leave earth as technical people and return to earth as astronaut. i am grateful for this platform. we will pave the way for so many more people to experiences. >> amanda, i want to end with

going back to the beginning. you mentioned it a few minutes ago. your family and the legacy of the family. in the video you announced your journey to space you mentioned that your family, your parents as boat refugees from vietnam, they look to the stars to guide their way to freedom. i will get choked up. you are a role model for me, for my daughter and others. not just in aapi community, but others you carry so much at a young age. you have done so much for others selflessly. some people might say, to go through sexual assault and survive it, there is a shame that comes with it. you battled against that and brought justice, account ability and power back to victims of sexual assault. now, you are taking over the mantle being the first vietnamese woman in space. how does it feel to constantly

have these firsts you are accomplishing and successfully dealing with? does that make you it's hard to do more? the sky is the limit, literally, for you. >> you will make me cry. my mom is across the ocean -- crossed the ocean so that i could survive. it is something authentic. i did not strive to be first. there is a thing that i think perhaps society gaslight people into hiding their ambition or the dreams. especially young women. they say it is crazy to have these ambitions. let me tell you right now, that every successful person has had to climb cringe mountain. when you are successful, all of the people that thought you were cringing are now saying you are in the expiration. i want to say to everyone, no matter who you are or where you are from, you matter and your
